RE: The tariff classification of toner cartridges from China or Japan.

Dear Mr. Sherman:

In your letter dated May 15, 2008 you requested a tariff classification ruling. You included descriptive information and samples with your request. The samples are being returned as requested. The merchandise at issue is referred to as toner cartridges. You submitted samples of five cartridges. Item numbers 497-1, 497-2, 497-3 and 497-4 are black, cyan, magenta and yellow cartridges respectively and designed for use on Oce model CX2100 multi-function printers. Item number 817-5 is a black cartridge compatible with several Oce multi-functional printers according to your information. The cartridges are imported with powdered toner for use in xerographic printing. The cartridges have all necessary components for simple installation by the user. All of the printers which these toner cartridges are designed for are capable of being connected to an automatic data processing machine or network.

The applicable subheading for the toner cartridges will be 8443.99.5015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for printing machinery…other printers, copying machines and and facsimile machines, whether or not combined; parts and accessories theeof: parts and accessories: other: other: for the goods of subheading 8443.31: other. The general rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
